TorqAI Terms of Use

These Terms of Use ("Terms") constitute a legal agreement between you and Tornatto Labs ("we", "us", "our") — not Apple — governing your use of the TorqAI mobile application ("App"). By using the App, you agree to these Terms.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Description of Service

TorqAI is an AI-powered tennis coaching app. You can upload video clips of your tennis strokes, and our AI analyzes your form and provides coaching feedback, drill suggestions, and progress tracking.

3. Subscriptions and Payment

• TorqAI offers a 30-day free trial and a paid subscription at $9.99/month, which includes weekly training programs, unlimited video analysis, and Form Lab progress tracking.
• Subscriptions are billed monthly through Apple's In-App Purchase system. Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time in your device's Settings > Apple ID > Subscriptions.
• Prices and usage limits for subscription plans may change. Apple will notify you of any price changes before renewal. You can cancel your subscription at any time if you do not agree with the updated terms.
• No refunds are provided for partial billing periods. Refund requests should be directed to Apple.

4. Free Trial

New users receive a 30-day free trial. The trial does not require payment. When the trial expires, you will need a paid subscription to continue using TorqAI.

5. User Content

• You retain ownership of any videos and content you upload to TorqAI.
• By uploading content, you grant us a limited license to process it through AI services (Anthropic Claude, Google Gemini) solely for the purpose of providing coaching analysis.
• You are responsible for ensuring you have the right to upload any content you submit.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload content that is inappropriate, offensive, or violates others' rights.
• Attempt to reverse-engineer, modify, or interfere with the App's functionality.
• Share your account credentials with others.

7. AI Coaching Disclaimer

TorqAI provides AI-generated coaching feedback for informational and educational purposes only. It is not a substitute for professional coaching or medical advice. Always consult a qualified coach or medical professional for personalized guidance, especially regarding injuries.

8. Account Termination

You can delete your account at any time from Settings > Delete Account in the App. We may also terminate or suspend your account if you violate these Terms. Upon deletion, all your data is permanently removed.

9. Limitation of Liability

TorqAI is provided "as is" without warranties of any kind. We are not liable for any injuries, losses, or damages arising from your use of the App or reliance on AI coaching feedback. Our total liability is limited to the amount you paid for the service in the preceding 12 months.

10. Maintenance and Support

Tornatto Labs is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services. For support, contact us at contact@tornattolabs.com.

11. Intellectual Property

The App, including its design, logos, and content, is the intellectual property of Tornatto Labs. In the event of any third-party claim that the App infringes intellectual property rights, Tornatto Labs (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

12. Apple Third-Party Beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
